You can steal his 3d model, make 32x32 image from it wihout mentioning the source. No one will know that, because it'll be very very hard to prove that you used exactly this model to do so. Then, you won't be able to sleep at nights, you'll think "Oh no, oh no. I stole the 3d model of Submachine Gun made by Kutejnikov from opengameart.org! How can I live after that?!". Then you'll lose your job, because of all that alcohol you consumed to forget about stealing 3d model of Submachine Gun made by Kutejnikov from opengameart.org. Then you will start taking drugs, your wife will leave you, she will take the house and children. You'll be lying on the street thinking about that 3d model made by Kutejnikov, how you stole it without mentioning his name. Then you won't be able to live any longer. You'll write a death note, where you will mention Kutejnikov, his 3d model of SMG and opengameart.org.
The reason you see AK-47, M16, MP5 and Desert Eagles everywhere is because owners of these guns are too lazy to do something about it, unless the game is super serious and famous. This is also the reason why you often see strange names and hybrids of weapons in many games. Like Deagle pistol instead of Desert Eagle, or simply "7.62mm Assault Rifle" which looks almost exactly like AK-47. Owners of all these trademarks can indeed sue you for using these weapons in your game, including this submission, but do you really think they will? They will pay attention only if your game will be like top-10 steam game, and even then they will first try to sell you the license to use their weapons in your game and get some profit. Otherwise they won't care that some indie dev made some game with a weapon there, which was played by like 100 people at best. They will never even know that you used their trade marked gun in your game.
Edit: Also don't forget that all that trademarked and copyrighted stuff usually doesn't apply to mods, so you can see star wars stormtroopers armors in almost every game as a mod and stuff like that. And so popular Counter-Strike was a Half-Life mod.
Try giving the player an ability to run your own settlement :D Defend if from attacks and personally recruit and train NPCs, from farmers and blacksmiths to guards and alchemists. NPCs will have permadeath, but will become better after each attack wave. You can personally invest gold in their training and buy them equipment.
Then you can take some of them on adventure and they will act as followers. Attack waves on your settlement can be either random or initialized by the player.
It has almost unlimited possibilities for future features expansions: like adding more resources and worker types or numerous buildings types and their upgrades. Later you can even add AI controlled settlements and add diplomacy on top of it with trading, war and battle alliances and even large scale battles inside settlements with pillaging and murdering the innocent. Then your settlement will have a reputation of evil raiders or heroes and others will react to your reputation, including your own NPCs.
